P\u0159i n\u00e1kupu p\u0159es realitn\u00ed\nkancel\u00e1\u0159 tuto smlouvu vypracov\u00e1v\u00e1 advok\u00e1t realitn\u00ed kancel\u00e1\u0159e. P\u0159i p\u0159\u00edm\u00e9m\nprodeji je mo\u017en\u00e9 si kupn\u00ed smlouvu nechat zpracovat advok\u00e1tem nebo upravit n\u011bjakou\nvzorovou smlouvu z&nbsp;internetu.<\/p>\n\n\n\n<p>Vzorov\u00e9 smlouvy\nsamoz\u0159ejm\u011b neobsahuj\u00ed v\u0161echny mo\u017en\u00e9 varianty, kter\u00e9 mohou p\u0159i prodeji\/n\u00e1kupu\nnastat a u slo\u017eit\u011bj\u0161\u00edch p\u0159\u00edpad\u016f je lep\u0161\u00ed se obr\u00e1tit na advok\u00e1tn\u00ed kancel\u00e1\u0159.<\/p>\n\n\n\n<p>Z\u00e1kladn\u00edm obsahem\nkupn\u00ed smlouvy je jedine\u010dn\u00e9 ur\u010den\u00ed prod\u00e1vaj\u00edc\u00edho a kupuj\u00edc\u00edho (titul, jm\u00e9no p\u0159\u00edjmen\u00ed,\nrodn\u00e9 \u010d\u00edslo(datum narozen\u00ed), adresa). Prod\u00e1vaj\u00edc\u00ed i kupuj\u00edc\u00ed nemus\u00ed b\u00fdt jedna,\nale m\u016f\u017ee jich b\u00fdt v\u00edce.<\/p>\n\n\n\n<p>D\u00e1le je nutn\u00e9\nspecifikovat jak\u00e1 nemovitost se kupn\u00ed smlouvou p\u0159ev\u00e1d\u00ed. Zde ji\u017e n\u011bkolik let\nplat\u00ed, \u017ee i v&nbsp;p\u0159\u00edpad\u011b staveb se nep\u0159ev\u00e1d\u00ed samotn\u00e1 stavba, ale p\u0159ev\u00e1d\u00ed se pozemek,\njeho\u017e sou\u010d\u00e1st\u00ed je stavba. Pozemek definujeme \u010d\u00edslem parcely, v\u00fdm\u011brou parcely(nemus\u00edme\nuv\u00e1d\u011bt), druhem pozemku, \u010d\u00edslem listu vlastnictv\u00ed(LV), katastr\u00e1ln\u00edm \u00fazem\u00edm,\nobc\u00ed a okresem. Je mo\u017en\u00e9 kupovat i pouze pod\u00edl na nemovitosti, nap\u0159. ide\u00e1ln\u00ed \u00bd nemovitosti.<\/p>\n\n\n\n<p>Je nutn\u00e9\nspecifikovat r\u016fzn\u00e1 omezen\u00ed zat\u011b\u017euj\u00edc\u00ed danou nemovitost jako jsou v\u011bcn\u00e1 b\u0159emena,\nz\u00e1stavn\u00ed pr\u00e1va apod. Tyto omezen\u00ed mohou m\u00edt v\u00fdrazn\u00fd vliv na cenu nemovitosti.<\/p>\n\n\n\n<p>Kupuj\u00edc\u00ed a&nbsp;prod\u00e1vaj\u00edc\u00ed\nse mus\u00ed dohodnout na v\u00fd\u0161i kupn\u00ed ceny a na zp\u016fsobu uhrazen\u00ed. Vzhledem k&nbsp;prodlev\u011b\ncca 30 dn\u00ed, kter\u00e1 nastane mezi uzav\u0159en\u00ed kupn\u00ed smlouvy, n\u00e1vrhu na vklad a\nzaps\u00e1n\u00edm nov\u00e9ho majitele do katastru nemovitost\u00ed, je zp\u016fsob \u00fahrady kupn\u00ed ceny\nvelmi d\u016fle\u017eit\u00fd. Zpravidla se pou\u017e\u00edv\u00e1 mechanismus, \u017ee se u advok\u00e1ta(p\u0159\u00edp. not\u00e1\u0159e)\npodep\u00ed\u0161\u00ed kupn\u00ed smlouvy ob\u011bma stranami. Kupn\u00ed smlouvu s&nbsp;ov\u011b\u0159en\u00fdmi podpisy\nsi vezme advok\u00e1t do \u00faschovy a kupuj\u00edc\u00ed m\u00e1 stanoven\u00fd term\u00edn do kter\u00e9ho mus\u00ed na\n\u00fa\u010det \u00faschovy slo\u017eit kupn\u00ed cenu a po ov\u011b\u0159en\u00ed advok\u00e1tem, \u017ee je cel\u00e1 kupn\u00ed cena na\n\u00fa\u010dtu \u00faschovy, advok\u00e1t zanese kupn\u00ed smlouvu spole\u010dn\u011b s&nbsp;n\u00e1vrhem na vklad na\nkatastr nemovitost\u00ed. Po z\u00e1pisu nov\u00e9ho vlastn\u00edka na katastru nemovitost\u00ed(cca\n25dn\u00ed), advok\u00e1t za\u0161le kupn\u00ed cenu na \u00fa\u010det prod\u00e1vaj\u00edc\u00edho. &nbsp;Tato varianta se zd\u00e1 b\u00fdt pro prod\u00e1vaj\u00edc\u00edho i\nkupuj\u00edc\u00edho nejbezpe\u010dn\u011bj\u0161\u00ed. Hlavn\u00ed nev\u00fdhodou t\u00e9to varianty m\u016f\u017ee b\u00fdt to, \u017ee do\ncel\u00e9ho procesu p\u0159evodu nemovitosti vstupuje t\u0159et\u00ed osoba(advok\u00e1t) a dal\u0161\u00ed smlouva(smlouva\no \u00faschov\u011b) \u2013 tato slu\u017eba nen\u00ed zadarmo, bude V\u00e1s st\u00e1t p\u00e1r tis\u00edcikorun a v&nbsp;p\u0159\u00edpad\u011b\nnepoctiv\u00e9 advok\u00e1tn\u00ed kancel\u00e1\u0159e V\u00e1s to m\u016f\u017ee ve v\u00fdsledku st\u00e1t i celou kupn\u00ed cenu(je\nnejlep\u0161\u00ed se ohl\u00e9dnout po zn\u00e1m\u00e9 advok\u00e1tn\u00ed kancel\u00e1\u0159i, nejl\u00e9pe se kterou m\u00e1me ji\u017e\nzku\u0161enosti). Je mo\u017en\u00e1 i \u00fahrada p\u0159\u00edmo od kupuj\u00edc\u00edho na \u00fa\u010det prod\u00e1vaj\u00edc\u00edho nap\u0159.\npo podpisu smlouvy. Tento zp\u016fsob se vyu\u017e\u00edv\u00e1 p\u0159i prodeji mezi zn\u00e1m\u00fdmi a u levn\u011bj\u0161\u00edch\nnemovitost\u00ed. <\/p>\n\n\n\n<p>Pokud prob\u00edh\u00e1\nfinancov\u00e1n\u00ed pomoc\u00ed hypote\u010dn\u00edho \u00fav\u011bru je cel\u00e1 transakce je\u0161t\u011b slo\u017eit\u011bj\u0161\u00ed o\nnutnost vlo\u017een\u00ed z\u00e1stavn\u00edho pr\u00e1va na nemovitost je\u0161t\u011b p\u0159ed \u010derp\u00e1n\u00edm pen\u011bz z&nbsp;hypot\u00e9ky.\nZ\u00e1stavn\u00ed smlouvu vkl\u00e1d\u00e1 na katastr prod\u00e1vaj\u00edc\u00ed a zastavuje tak svoji nemovitost\n\u00fav\u011brem prod\u00e1vaj\u00edc\u00edho. <\/p>\n\n\n\n<p>Dal\u0161\u00edm krokem je ur\u010den\u00ed kdo pod\u00e1 kupn\u00ed smlouvu a <a href=\"http:\/\/realhelp.cz\/?p=115\">n\u00e1vrh na vklad<\/a> na katastr nemovitost\u00ed(prod\u00e1vaj\u00edc\u00ed\/kupuj\u00edc\u00ed\/advok\u00e1t(viz v\u00fd\u0161e)) a kdo pod\u00e1n\u00ed tohoto n\u00e1vrhu zaplat\u00ed(v sou\u010dasn\u00e9 dob\u011b 2.000K\u010d).<\/p>\n\n\n\n<p>Smlouva se vyhotovuje\nv&nbsp;n\u011bkolika stejnopisech.
